Power of Attorney

A Power of Attorney (POA) is a legal document with which you (‘the donor’) give one or more persons (‘the attorney’) the right to make important decisions on your behalf. This enables people you trust to give the support you may need and gives them your authority to do it.

To set up a power of attorney you need to have sound mental capacity so it’s worth putting one in place in advance of any health issues.

An ordinary power of attorney loses its validity when you lose the mental capacity to manage your own affairs.

An Enduring Power of Attorney (EPA) is a legal document in which you (‘the donor’) appoint one or more persons (‘the attorney’) to look after your affairs if you lose mental capacity. When the time comes to implement the document, the ‘Donor’ would need to be assessed by a medical professional to establish that they are losing or have lost mental capacity.
